(1) To determine the amount of compensation to be given in accordance with sub-section (3) of section 10 of the Act, there shall be a compensation determination committee with the following chairman and members:-
(a) Person appointed by the Government of Nepal – Chairman
(b) Representative of the office related to the water resource utilization project – member
(c) Experts designated by the Government of Nepal related to water resources - members
(2) For the purpose of determining the amount of compensation to be given as per section 15 and 16 of the Act, the following persons shall also be members of the committee specified in sub-rule (1):-
(a) The owner of the damaged immovable property or his representative – member
(b) Representative of the concerned District Revenue Office of the area where the damaged immovable property is located - member
(c) Member of the concerned village development committee or municipality of the area where the damaged immovable property is located – member
(3) The compensation determination committee according to sub-rule (1) while determining the amount of compensation shall determine the amount of compensation after evaluating the direct and actual loss.
(4) The procedure for the meeting of the compensation determination committee can be determined by the said committee itself
